Essentially, this still leaves you with two options:

1)      Your local can choose to not sign the MOU – your district can then proceed without your signature if they choose. Below, you’ll find talking points that may be of assistance to you if you choose to not sign.

2)      If your local wants to sign the MOU and support the district’s efforts to secure RTTT funding based on the latest incomplete draft plan, you can do that.  If you choose to do so, we recommend that you include the following language in the MOU that protects your bargaining rights:

Nothing in this Memorandum of Understanding shall be construed to alter or otherwise affect the rights, remedies, and procedures afforded school district employees under Federal, State, or local laws (including applicable regulations or court orders) or under the terms of collective bargaining agreements, memoranda of understanding, or other agreements.  Any portion of this Memorandum of Understanding that impacts upon a mandatory topic of bargaining not covered by an existing collective bargaining agreement, memorandum of understanding, or other agreement shall be implemented only after an agreement is reached through collective bargaining.

So I can choose to sign or not sign or whatever. And the best part is that Superintendent Flanagan says Michigan probably won’t get any money after all is said and done. Yeah. We get new laws and fewer rights and more duties and on-paper school reform, but no money to pay for it all. That’s change we can believe in.
